Step-by-step process on setting aside a judgment, order or direction given by the CDRT.

​You can apply to set aside a judgment, order or direction given by the Community Disputes Resolution Tribunal (CDRT).

Step 1

Consider whether you have sufficient reasons to apply to set aside the judgment, order or direction given by the CDRT. Gather the necessary evidence to support your case.

Step 2

The application to set aside a judgment, order or direction must be filed within 14 calendar days after the date of the judgment, order or direction.

E.g. If the judgment was made on 1 July 2015, the applicant must file the application by 15 July 2015 at the latest.

Step 3

File an Application to set aside cum Supporting Affidavit and supporting evidence in the Community Justice and Tribunals System (CJTS).

For the purpose of the proceedings, you will be known as the Applicant and your neighbour will be known as the Respondent.

Step 4

At the time of filing, a Notice of Hearing to the Applicant and the Respondent to attend a Hearing at the CDRT on a specified date and at a specified time will be generated in CJTS.

Step 5

Within 7 calendar days after the Application is filed in CJTS, the Applicant must serve one (1) set of the Application cum Supporting Affidavit and one (1) set of the supporting evidence on the Respondent.

Step 6

If the Respondent intends to contest the Application, the Respondent has 14 calendar days after being served with the Application cum Supporting Affidavit and the supporting evidence to file his Reply cum Supporting Affidavit, together with the supporting evidence, in CJTS.

Step 7

Within the same 14-day period, the Respondent must serve one (1) set of the Reply cum Supporting Affidavit and one (1) set of the supporting evidence on the Applicant.

Step 8

The Applicant and the Respondent must attend the hearing at the CDRT on the specified date and at the specified time.

Things to bring:

  1. National Registration Identity Card (for Singapore citizen/ Permanent Resident)
  2. Passport and Employment Pass (for foreign citizen)
  3. One (1) set of the Application cum Supporting Affidavit, Reply cum Supporting Affidavit and supporting evidence

If the CDRT judge decides to make a Court Order to set aside the judgment, order or direction, the CDRT will prepare the Court Order immediately after the hearing. The Applicant will extract the Court Order and serve it on the Respondent according to the directions that the CDRT judge has given.
